BACKGROUND:

 

  1. This agreement applies as between the User, the User of this Website and London Coin Galleries Limited, (a company registered in England and Wales under 08817865 of 6 Shepard Street London W1J7JE (the Company), the owner of this Website. 
  2. This Policy applies to the Company’s use of any and all Data collected by the Company in relation to the User’s use of the Website and any Services or Systems therein.
  3. By using this website the User hereby agree to the terms of this Privacy Policy.
  4. This Privacy Policy is to be read in conjunction with the Terms and Conditions.

 

1.             Definitions and Interpretation

In this Policy the following terms shall have the following meanings: 

 

“Account”

means collectively the personal information, Payment Information and credentials used by Users to access Material and / or any communications System on the Website;

Content”

means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Website;

means a small text file placed on the User’s computer by the Company when the User visits certain parts of this Website.  This allows the company to identify recurring visitors and to analyse their browsing habits within the Website.  Further details are contained in clause 11 of this Policy;

means collectively all information that the User submits to the Website.  This includes, but is not limited to, Account details and information submitted using any of the Company’s Services or Systems;

means collectively any online facilities, tools, services or information that the Company makes available through the Website either now or in the future;

means any natural person who accesses the website who is not employed by the Company.;; and

“Website”

means the website that the User is currently using www.lcgcoins.com and any sub-domains of this site  unless expressly excluded by their own terms and conditions.



2.             Data Collected

Without limitation, any of the following Data may be collected:

2.1           name;

2.2           contact information such as address, email addresses and telephone numbers;

2.3           demographic information such as coin collecting interests;

2.4           IP address (automatically collected);

2.5           web browser type and version (automatically collected);

2.6           operating system (automatically collected);

2.7           a list of URLS starting with a referring site, the User’s activity on this Website, and the site the User exits to (automatically collected); and

2.8           Cookie information (see clause 11 below).

3.             The Company’s Use of Data

3.1           Any personal Data the User submits will be retained by the Company for as long as the User uses the Services and Systems provided on the Website.  Data that the User may submit through any communications System that the Company may provide may be retained for a longer period of up to six months.

3.2           Unless the Company is obliged or permitted by law to do so, and subject to clause 4, the User’s Data will not be disclosed to third parties.  This does not include the Company’s affiliates and / or other companies within the Company’s group.

3.3           All personal Data is stored securely in accordance with the principles of the Data Protection Act 1998.  For more details on security, see clause 10 below.

3.4           Any or all of the above Data may be required by the Company from time to time in order to provide the User with the best possible service and experience when using the Website.  Specifically, Data may be used by the Company for the following reasons:

3.4.1      internal record keeping;

3.4.2      improvement of the Company’s products / services;

3.4.3      transmission by email of promotional materials that may be of interest to the User;

3.4.4      contact for market research purposes which may be done using email, telephone, fax or mail.  Such information may be used to customise or update the Website.

4.             Third Party Websites and Services

The Company may, from time to time, employ the services of other parties for dealing with matters that may include, but are not limited to, payment handling, delivery of purchased items, search engine facilities, advertising and marketing.  The providers of such services do have access to certain personal Data provided by Users of this Website.  Any Data used by such parties is used only to the extent required by them to perform the services that the Company requests.  Any use for other purposes is strictly prohibited.  Furthermore, any Data that is processed by third parties must be processed within the terms of this Policy and in accordance with the Data Protection Act 1998.

5.             Changes of Business Ownership and Control

5.1           The Company may, from time to time, expand or reduce its business and this may involve the sale of certain divisions or the transfer of control of certain divisions to other parties.  Data provided by Users will, where it is relevant to any division so transferred, be transferred along with that division and the new owner or newly controlling party will, under the terms of this Policy, be permitted to use the Data for the purposes for which it was supplied by the User.

5.2           In the event that any Data submitted by Users will be transferred in such a manner, the User will be contacted in advance and informed of the changes.  When contacted the User will be given the choice to have their Data deleted or withheld from the new owner or controller.

6.             Controlling Access to Data

6.1           Wherever the User is required to submit Data, the User will be given options to restrict the Company’s use of that Data.  This may include the following:

6.1.1      use of Data for direct marketing purposes; and

6.1.2      sharing Data with third parties.

7.             Right to Withhold Information

7.1           The User may access certain areas of the Website without providing any Data at all except for the Data automatically collected as set out in clause 2.  However, to use all Services and Systems available on the Website the User may be required to submit Account information or other Data.

7.2           The User may restrict their internet browser’s use of Cookies.  For more information see clause 11 below.

8.             How The Company Uses Personal Information (Data Protection)

8.1           All personal information that the Company may collect (including, but not limited to, the User’s name and address) will be collected, used and held in accordance with the provisions of the Data Protection Act 1998.

8.2           The Company may use personal information to:

8.2.1      Provide Goods and services to the User;

8.2.2      Process payment for the Goods; and

8.2.3      Inform the User of new products and services available from the Company.  The User may request that the Company stop sending the User this information at any time.

8.3           In certain circumstances (if, for example, the User wishes to purchase Goods on credit), and with the User’s consent, the Company may pass the User’s personal information on to credit reference agencies.  These agencies are also bound by the Data Protection Act 1998 and should use and hold the User’s personal information accordingly.

8.4           The Company will not pass on the User’s personal information to any other third parties without first obtaining the User’s express permission save for the provisions in clause 4.

9.             The User Accessing their own Data

9.1           The User may access their Account at any time to view or amend the Data.  The User may need to modify or update their Data if their circumstances change.  Additional Data as to the User’s marketing preferences may also be stored and the User may change this at any time.

9.2           The User has the right to ask for a copy of their personal Data on payment of a fee to be agreed between the User and the Company at the time such a request is made.

10.          Security

10.1        The Company has put in place suitable physical, electronic and managerial procedures to safeguard and secure Data collected online.

10.2        Specifically the Company utilises firewall, server security configuration, encryption and anti-virus software.

11.          Cookies

11.1        The Website uses cookies to distinguish the User from other users of the Website. This helps the Company to provide the User with a good experience when browsing the Website and also allows the Company to improve the Company’s site. By continuing to browse the site, the User agrees the Company’s use of cookies.
